Who We Are

This Website www.assurantforadvisers.co.uk (the "Service") is operated by Assurant Intermediary Limited (“AIL”), with mailing address of Emerald Buildings, Westmere Drive, Crewe, Cheshire, CW1 6UN, a member of the Assurant, Inc. group of companies (hereinafter, “We”, “Us”, or “Our”). AIL is the data controller of Your Personal Information in the context of the Service.

For the purposes of this Notice, “You” or “Your” refers to the broker or intermediary user accessing and using the Service on behalf of their business or organization, and “Customer” or “Customers” refer to the individual or individuals whose Personal Information is being input, accessed, or otherwise processed by You through the Service, including individuals for whom You obtain insurance product quotes, update account details, or manage policies.

This Privacy Notice (“Notice”) explains how we collect, use, and protect personal information relating to an identified or identifiable individual (“Personal Information”) when You use the Service. The Service allows You to update account details, obtain insurance product quotes and policies on behalf of Customers, access policy documents and forms (such as viewing policy terms and conditions or printing certificates of coverage), and contact broker support.

We use Personal Information to provide Our insurance and related products and services, to communicate with You, and to monitor and improve the Service and our offerings. Both Your Personal Information and the Customer’s Personal Information will be processed in accordance with all applicable data protection laws (“Applicable Law”).

Before providing us with Personal Information about other individuals (such as Your Customers), You should inform them about Our Consumer Privacy Notice, available at https://www.assuranthomeinsurance.co.uk/Customer-privacy-policy/. Where required under applicable data protection laws, You must also ensure that You have an appropriate legal basis to share the Customer’s Personal Information with Us.

This Notice applies to the Service only and does not necessarily reflect practices with respect to information gathered through other services We offer or websites We operate or the collection of information through off-line means.  To review the privacy practices of those other services, please refer to the policies provided in association with each.

  1. Personal Information We Collect

We collect Your Personal Information and the Customer’s Personal Information in the following situations:

1.1.           When You Create or Update an Account

We collect Personal Information from You when You apply for a broker account on the Service. To create an account on the Service, We ask brokers to provide Us with their contact details (for example - contact name, email address, telephone number, full individual or company name and FCA number). You may update Your account details at any time through the Service. We will also collect Your Internet Protocol (“IP”) address.

1.2.                   When You Request a Quote

We collect Personal Information from Customers when You submit a request for an insurance quote.  When You submit a quote request, We may ask You to provide Us with Customer Personal Information: Customer contact details (for example, telephone number, address).

1.3.                   When You communicate with Us or contact Us for Customer Support

When You contact Our broker support team (for example, when You enquire about the status of Your agency), We will collect information that You provide to Us in Your communications (such as the query or issue that You have raised).

1.4.                   When You access the Service

We collect information about devices used to access Our Service, (including IP address, browser used, browser language preferences, screen settings). Additionally, We use cookies and similar technologies such as web beacons to collect information about how You use and navigate Our Service (for example, the pages that You view and links that You click). We use cookies to help Us recognize You, improve Your experience, increase security, and measure use and effectiveness of Our services.   1. Purposes and Legal Basis for the Processing of Personal Information We process Your Personal Information and the Customer’s Personal Information for the following purposes:
  • To fulfil a contract, or take steps in preparation for entering into a contract: this is relevant where You submit a request for an insurance quote on behalf of a Customer.

This includes:

    • providing the Service;
    • verifying Your identity;
    • processing Your quote request on behalf of a Customer; and
    • communicating with You, and respond to any comments and complaints that You may send Us.
  • As required by Us to conduct Our business and pursue Our legitimate interests, in particular:
    • We monitor use of the Service, and use Your Personal Information to help Us to track and analyze preferences and trends, evaluate possible new features, functionality and services, and improve Our Service.
    • We use Personal Information to help Us recognize You on the Service, improve Your experience, increase security of Our networks and systems, and measure use and effectiveness of Our Service.
    • We use Personal Information You provide to investigate complaints received from You or from others, about the Service or Our products and services. We also use this Personal Information to track potential issues (for example, issues with fulfilment of services) to better serve You;
    • We monitor Customer accounts to prevent, investigate and/or report fraud, misrepresentation, or crime, in accordance with Applicable Law;
    • We will use Personal Information in connection with legal claims (for example; relating to sales and product complaints), compliance, regulatory and investigative purposes as necessary (including disclosure of such information in connection with legal process or litigation);
    • We use Personal Information of some individuals to invite them to take part in market research and broker surveys; and
    • We use Personal Information to send You information about Assurant products and services, such as customer experience surveys (where Your consent is not required).
  • Where You give Us consent:
    • We place cookies and use similar technologies in accordance with Our Cookie Notice and the information provided to You when those technologies are used.  You may withdraw Your consent at any time. 
    • For purposes which are required by law:
    • In response to requests by government or law enforcement authorities conducting an investigation; and
    • Responding to complaints where We are under a legal or regulatory obligation to adhere to a complaints handling procedure.
  1. How We Use Data to Make Automated Decisions

We use automated decision making, including profiling, to assess insurance risks, provide and manage quotes for insurance products and administer a Customer Policy. Automated decision-making tools do not involve human input and these tools apply pre-defined logic programming and criteria to make a decision. For example, when You submit Customer Personal Information to request a quote for insurance contents coverage, We carry out automated decision making. We provide a quote to You based on the information provided about the Customer and overall risk of the insurance required.

Under applicable data protection laws, including the GDPR, individuals have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning them or significantly affects them. They may also request human intervention, express their point of view, or contest the decision.

To help Us process the request, please ensure that either You or the Customer provide a name, email address, the relevant policy or quote reference number, and a brief description of the issue or concern.

4.      Disclosure of Personal Information

4.1.  Disclosure to Our Affiliates

We will disclose Your Personal Information, and the Customer’s Personal Information, to other Assurant group companies where necessary to perform tasks directly related to the provision of the Service. For example, We may share such information with Our affiliates to manage an insurance product quote request or to support the administration of a Customer’s policy.

4.2.  Disclosure to Our Service Providers and Partners

 We engage third‑party companies and individuals to support the operation and delivery of the Service (for example, to assist with Customer communications, application or database hosting, development, payment processing, services provided by other insurance companies such as reinsurers, and fraud detection and prevention). These third parties have limited access to Your Personal Information and the Customer’s Personal Information solely to perform these tasks on Our behalf and are contractually obligated to protect that information. To process an insurance product quote request, We may share the Customer’s name, contact details (including postal address, email address, and mobile number), and any other Customer data that You provide to Us.

 

4.3.  Disclosure to Public Authorities

We may disclose Your Personal Information or the Customer’s Personal Information if required for the purposes above, if mandated by law or if required for the legal protection of Our legitimate interests in compliance with Applicable Law.

4.4.  Other Categories of Recipients

 We may also disclose Your Personal Information and the Customer’s Personal Information (along with related usage information and any other information about You or the Customer) to third parties that acquire all or part of Our business or assets, as well as to Our attorneys, auditors, and external consultants. In the event of a bankruptcy, insolvency, or reorganization proceeding involving Us, Your Personal Information and the Customer’s Personal Information may be considered company assets and could therefore be sold, transferred, or otherwise disclosed to third parties as part of that process.

 

5.      Where Your Data and the Customer’s data is Processed

In providing the Service, Personal Information is stored within the United Kingdom. Information may be accessed or viewed outside of the UK.

6.      Your Choices and Rights

 Both You and any Customer whose Personal Information You provide have the following rights in relation to Personal Information, subject to Applicable Law:

  • Right to rectification of inaccurate or incomplete data 
  • Right to erasure in specific circumstances 
  • Right to restriction of processing in certain cases 
  • Right to withdraw consent at any time 
  • Right to data portability when processing is based on consent or contract 
  • Right to object to processing based on legitimate interests or for direct marketing 

In some cases, Assurant may be unable to fulfil a request due to legal obligations.

You or the Customer may request access to Personal Information held by Us by completing Our Data Subject Rights Request Form, available at: www.assurant.com/dataprotection/eu or by sending Us a written request to the address listed in section 11 "Contact Us" of this Policy.  We may ask You or the Customer to provide sufficient information to verify identity before granting access to Personal Information.

 We will review each request and, where applicable, make any required updates, rectifications, or deletions. We will respond to requests within one month, or within the timeframe permitted under Applicable Law.

 If You or the Customer believe that the processing of Personal Information constitutes a breach of data protection legislation, You or the Customer have the right to lodge a complaint with the UK Information Commissioner’s Office (ICO) at: https://ico.org.uk/.

  1. Communications from Us

We communicate with You through email and the Service. We will send You service-related communications (for example, “Your request for a quote has been processed”), customer satisfaction and market research surveys.

You can change Your email and contact preferences through the Service, You will need to log into Your account and select configuration or contact Us https://www.assurantforadvisers.co.uk/contact-us/.

If the Customer wishes to contact Us directly, they may also use the same contact link above.

Please note that You cannot opt out of receiving servicerelated communications from Us, as these messages are necessary for Us to provide the Service and fulfill Our contractual obligations.

8.      Data Retention

We retain Personal Information You provide as needed to provide the Service. We may retain Your or the Customer’s Personal Information if retention is reasonably necessary to comply with Our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce this Notice and Our Terms of Use. We may retain Personal Information for a limited period of time if requested by law enforcement. Our customer support may retain information for as long as is necessary to provide support-related reporting and trend analysis only, but We generally delete or de-personalize transaction-related data consistent with this Notice.  Once Personal Information is anonymized, We may retain and use such information.  Additionally, We maintain logs and backups for security, debugging, and site stability purposes for up to 30 days after Your transaction has been completed.

We typically delete logs and other backup information through the deletion process within 12 months of Your last activity, except as noted in Section 5. Where We process user account creation data, We do this for as long as You are an active user of Our site and for 6 years after this. Where We process Personal Information in connection with performing a contract, We keep the data for 7 years from Your last interaction with Us.

9.      Information Security

 We have implemented safeguards designed to protect Your Personal Information and the Customer’s Personal Information in accordance with industry standards.

We have measures in place to restrict access to Personal Information to those individuals whom We know have a valid business purpose to have access to such data. We maintain physical, electronic and procedural safeguards. We follow generally accepted standards designed to protect the Personal Information submitted to Us, both during transmission and once We receive it. We require those who provide services for Us and to whom We provide Personal Information collected through the Service to keep such information secure and confidential.

10. Important Information

10.1.  Minimum age

 We do not knowingly collect Personal Information from anyone under the age of 18. Both You and the Customer must be at least 18 years of age to use the Service or to provide Personal Information through it.

10.2. Changes to this Notice

We may update this Notice from time to time. If We make any material changes to Our Notice, We will notify You by email or by means of a notice through the Service, or by other means prior to the change becoming effective, so that You may review the changes before You continue to use the Service. Please review changes carefully and inform the Customer accordingly.
